DESCONSTRUÇÃO CONSTITUCIONAL: UMA REVISITAÇÃO AOS PROCESSOS INFORMAIS DE MUDANÇA DA CONSTITUIÇÃO – CONSTITUTIONAL DECONSTRUCTION: A REVISITING TO THE INFORMAL PROCESSES OF CONSTITUTIONAL CHANGE

O presente estudo analisa se as mutações constitucionais decorrentes da necessária atualização das normas constitucionais (conciliação da realidade política com a realidade jurídica) podem gerar a perda da força normativa da Constituição a ponto de culminar num processo de desconstrução da própria Constituição como símbolo fundante do povo em determinado Estado, bem como investiga se a desconstrução constitucional é uma consequência dos processos informais de mudança da Constituição ou apenas mais uma de suas modalidades.

ABSTRACT: The present study examines whether the constitutional changes necessary due to updating of constitutional norms (reconciliation of political reality with the legal reality) can cause the loss of the normative force of the Constitution as to culminate in a process of deconstruction of the Constitution as a symbol of the founding people in a specific state, and investigates whether the constitutional deconstruction is a result of informal processes of change in the Constitution or just another one of its modalities.
