IDADE DE CORTE E ACESSO AO ENSINO BÁSICO E FUNDAMENTAL: INCONSTITUCIONALIDADE – CUTTING AGE FOR BASIC AND PRIMARY EDUCATION ACCESS: UNCONSTITUTIONALITY

O direito à educação está presente no ordenamento jurídico brasileiro desde a Constituição do Império, de 1824. Atualmente, além das disposições constitucionais, a legislação ordinária também disciplina a educação, sendo o Estatuto da Criança e do Adolescente e a Lei de Diretrizes Básicas da Educação as principais leis neste assunto. O presente estudo trata do direito de as crianças ingressarem nas etapas escolares, independentemente de suas datas de aniversário (isto é, ainda que não completem certa idade no 1º trimestre ou semestre do ano, deverão ter assegurado o direito a cursar o ensino básico e fundamental. Justifica-se o tema pela recorrência com que fomos procurados para atender crianças para as quais negou-se matrícula sob a justificativa de não completarem determinada idade até certo momento do ano de ingresso. É constitucional a negativa das escolas com base no critério etário? Ao longo deste artigo, responderemos a essa questão e esmiuçaremos o assunto trazendo nossa contribuição pessoal e os contornos doutrinário-jurisprudenciais atuais.

ABSTRACT: The right to education is provided for in the Brazilian legal system since the first Constitution of 1824. Currently, in addition to the constitutional provisions, the ordinary legislation also provides for education through the Statute of Children and Adolescents and the Law of Basic Guidelines of Education, the main laws on this subject. This study deals with the right of children's entering in school regardless of their birthdays (i.e., even though they do not complete certain age in the first quarter or semester of the year, they should be guaranteed the right to attend the school). The importance of the theme is the recurrence with which we were contacted to defend children’s right in view of their tuition refused under the justification of not completing certain age at certain time of the year of admission. Is the age criteria in accordance with the constitution? Throughout this article we will answer that question and scrutinize the subject bringing our personal contribution and the doctrinal and jurisprudence.
