SENTIDO E AMPLITUDE DA RESERVA DO POSSÍVEL EM MATÉRIA DE SAÚDE – DIRECTION AND AMPLITUDE OF THE RESERVE OF THE POSSIBLE IN HEALTH MATTERS

O presente artigo visa à discussão de uma problemática evidente em matéria de saúde: a negativa de um direito social básico que tem em sua essência o princípio da dignidade da pessoa humana conflitando com a reserva do possível. logo, faz-se necessária a reinterpretação da reserva do possível, objetivando a busca da interpretação do real interesse público, o que sempre deverá ser um espelho da primazia da dignidade da pessoa humana, na busca do alcance do mínimo existencial.

ABSTRACT: This article aims to discuss a problem evident in health: the denial of a basic social right which has at its core the principle of human dignity in conflict with the reserve of the possible. Therefore, it is necessary to reinterpret the reserve of the possible, aimed at seeking the interpretation of the real public interest, which should always be a mirror of the primacy of the human dignity in the search range of the existential minimum.
