AS CONVENÇÕES DE GENEBRA E O ESTATUTO DE ROMA: NORMAS DE EFEITO MORAL? – THE GENEVA CONVENTIONS AND THE ROME STATUTE: RULES OF MORAL EFFECT?

As quatro Convenções de Genebra tutelam os combatentes e civis envolvidos nos campos de batalha espalhados pelo mundo. São os atores do chamado “teatro de operações”, valendo-nos de terminologia castrense. Cada qual, à sua maneira, é vítima da barbárie inexplicável que move os anseios beligerantes existentes no ser humano. Ocorre que, nem mesmo após a edição dessas quatro convenções, suas normas foram absolutamente observadas, principalmente por alguns dos Estados signatários. A Segunda Guerra Mundial está recheada de relatos históricos que atestam o descumprimento de determinações dessas convenções. Até mesmo o Brasil, de tradição pacifista, parece ter agido incoerentemente contra o texto assinado por seus dignitários. O que ocorreu no passado? O que ocorre ainda hoje? A Cruz Vermelha e o Crescente Vermelho conseguem atingir os fins para o quais foram criados? Como fica a ONU nesse cenário? E a Igreja Católica? O Estatuto de Roma, que criou o Tribunal Penal Internacional de caráter permanente, não conseguiu condenar alguns dos criminosos mais brutais. Por quê? Pretendemos abordar cada uma dessas questões de maneira bastante franca, percorrendo o iter da humanidade, desde a Grécia Antiga até hoje.

ABSTRACT The four Geneva’s Conventions keep under their jurisdiction fighters and civilians involved in the battlefields around the world. They are actors of “operations’ theater”, using military terminology. Each one, in its own way, is a victim of barbarism that moves the inexplicable longings factions existing in humans. Even after the publication of these four conventions, its rules were not completely observed, especially by some of the signatories. The Second World War is full of historical accounts that attest to the failure of determinations of these conventions. Even Brazil, a traditional pacifist, appears to have acted inconsistently against the text signed by its leading officials. What happened in the past? What happens today? The Red Cross and Red Crescent can achieve the purposes for which they were created? What about the UN in this scenario? And the Catholic Church? The Rome Statute, which created the International Criminal Court on a permanent basis, failed to condemn some of the most brutal criminals. Why? We intend to address each of these issues quite frankly, going through ways of mankind, from ancient Greece till today.
