CRISE FINANCEIRA DE 2008: A INTERVENÇÃO DO ESTADO NO DOMÍNIO ECONÔMICO – FINANCIAL CRISIS OF 2008: STATE INTERVENTION IN THE ECONOMIC DOMAIN

O artigo em questão aborda um aspecto importante da crise financeira de 2008, iniciada nos EUA e que se alastrou por toda a comunidade global: a intervenção do Estado como remediador ou inibidor dos efeitos nefastos da crise. Nesse prisma, enfoca-se a intervenção estatal do governo brasileiro no cenário econômico, com o objetivo de se evitar o alastramento de um pânico geral que poderia levar uma simples recessão a uma das maiores crises da República. Com essa meta, é feita uma análise dos instrumentos que a Constituição Federal oferece ao governo para a intervenção estatal, dados que servem de norte quando se analisam as medidas governamentais tomadas para a preservação da economia, expressa manutenção da demanda, consumo e postos de trabalho. Após a obtenção desses dados, conclui-se se as medidas governamentais tomadas no período de crise seguiram os ditames institucionais previstos pela Carta Constitucional, previstos no capítulo da Ordem Econômica e Financeira.

ABSTRACT: The article in question will address an important aspect of the 2008 financial crisis, which began in the United States of America and has spread throughout the global community: state intervention as remediation or inhibitor to the harmful effects of the crisis. In this light, it will focus on state intervention of the Brazilian government in the economic scenario in order to prevent the spread of a general panic that could lead a simple recession to one of the greatest crises of the Republic. With this aim, it is made an analysis of tools that the Federal Constitution provides for the government to state intervention, data that will serve as the north when analyzing the governmental measures taken to preserve the economy, expressed as maintenance of demand, consumption and jobs. After obtaining these data, it will be conclude if the government measures taken in the period of crisis follow the institutional dictates laid down by the Constitutional Charter provided in Chapter of the Economic and Financial Order.
