A EXECUÇÃO COLETIVA DE DIREITOS INDIVIDUAIS HOMOGÊNEOS – COLLECTIVE ENFORCEMENT OF HOMOGENEOUS INDIVIDUAL RIGHTS

Este artigo acadêmico se dedica ao estudo da tutela coletiva dos direitos individuais homogêneos na fase de cumprimento, assumindo posição firme pela liquidação e execução coletiva da sentença, em prol da efetividade do processo. Aborda-se de forma pragmática e objetiva a doutrina e a jurisprudência consolidada do STJ e do STF, resolvendo dificuldades operacionais e propondo soluções criativas que não ofendam ao devido processo legal.

ABSTRACT: This paper studies the collective protection of individual rights in phase of compliance, taking firm stand for the liquidation and collective enforcement of the judgment in favor of the effectiveness of the process. Discusses, pragmatically and objectively, consolidated doctrine and jurisprudence of the STJ and the STF, resolving operational difficulties and offering creative solutions that do not offend due process of law.
