A GESTÃO DA “JUSTIÇA DE PROXIMIDADE” NA FRANÇA: A ANÁLISE DA POLÍTICA PÚBLICA JUDICIÁRIA – THE MANAGEMENT OF SMALL CLAIM COURTS IN FRANCE: THE ANALYSIS OF JUDICIAL PUBLIC POLICY

Este trabalho desenvolve uma análise da implantação das jurisdições de proximidade após a reforma do Judiciário francês entre 2002 e 2006. O objetivo é investigar a atividade judiciária no nível local durante o período mencionado, para compreender a implementação a partir de um quadro de análise que considera tal dispositivo como uma política pública judiciária. Os dados oficiais publicados nos relatórios anuais do Ministério da Justiça foram usados como fontes empíricas para comparar a atividade judiciária em nível local. O artigo analisa, assim, os resultados locais em duas jurisdições no Sudeste da França: as cortes de apelação em Montpellier e em Nîmes. Os resultados apontam para uma racionalidade de implementação que põe em relevo as configurações institucionais locais na execução dessa política pública judiciária.

ABSTRACT: This paper develops an analysis of the judiciary reform implementation along 2002 and 2006. In this period, a new judiciary institution was created: the small claim courts. It aims to investigate the judiciary activity in the mentioned period to understand the implementation of a public policy in a judiciary institution. The Justice’s Annual Reports of the French Ministry of Justice’s official data were used as empirical resources to compare the judiciary activity at local level. Moreover, it analyzes the local outcomes in two jurisdictions in southern France: Montpellier Appeal Court and Nîmes Appeal Court. The results points to a hypothesis of a implementation rationality attached to local institutional configurations in the execution of this judicial public policy.
