A HISTÓRIA AMERICANA E OS PARÂMETROS CONTEMPORÂNEOS PARA A APLICAÇÃO DO JUS AD BELLUM – AMERICAN HISTORY AND CONTEMPORARY PARAMETERS FOR THE APPLICATION OF JUS AD BELLUM

Desde o período histórico conhecido por “guerra fria”, os estudiosos políticos se questionam sobre quem possui legitimidade e quais os critérios objetivos para se fixar o campo de operação do Direito que cuida da declaração da guerra, juridicamente denominado de “jus ad bellum”. Com a queda do bloco soviético, o mundo viu surgir o unilateralismo político-militar da superpotência estadunidense. Se, antes, duas nações decidiam os destinos de todo o planeta, doravante tal atribuição restou entregue à grande potência norte-americana. Quem seria capaz de restringir eventuais radicalismos no momento de se fixar os limites entre declarar a guerra ou apelar para acordos diplomáticos? A Organização das Nações Unidas (ONU)? O quadro político internacional se alterou muito desde a Carta de São Francisco (26/7/1945) e hoje a legitimidade do Conselho de Segurança da ONU é abertamente questionada. Os Estados Unidos da América (EUA) têm uma história de guerras, sucessos e fracassos capazes de nos fazer compreender melhor essa relação entre a grande nação do norte e os conflitos armados. O presente artigo propõe-se a analisar essa relação.

ABSTRACT: Since the historical period known as the "cold war", political scholars questioning who has legitimacy and the objective criteria to establish the field of operation of the right that takes care of the declaration of war, legally named "jus ad bellum". With the fall of the soviet bloc, the world saw the political and military unilateralism of american superpower. If before two nations decided the fate of the entire planet, henceforth such attribution remains turned over to the american superpower. Who would be able to restrict any radicalism at the time to fix the boundaries between declare war or appeal for diplomatic agreements? The United Nations (UN)? The international policy framework has changed a lot since the San Francisco Charter (June 26, 1945) and today the respectability of the UN Security Council is openly questioned. The United States of America (USA) have a history of wars, successes and failures that can make us better understand this relationship between the great northern nation and armed conflict. This article proposes to examine this relationship.
