O SISTEMA RECURSAL À LUZ DO PROJETO DO NOVO CÓDIGO DE PROCESSO CIVIL – THE PROCEDURAL SYSTEM UNDER THE PROJECT OF THE NEW CODE OF CIVIL PROCEDURE

O presente artigo visa a analisar o projeto de novo Código de Processo Civil (CPC) no relativo ao sistema recursal, sob a ótica da efetividade e da celeridade do processo judicial. Tal trabalho se propôs haja vista serem os recursos um dos pontos mais criticados no atual código em razão da alegada ausência de sistematicidade. Nesse sentido, vislumbra-se realizar um exame crítico do Projeto de Lei (PL) nº 8.046/10, atualmente em tramitação na Câmara dos Deputados, indicando as suas novidades em relação a atual sistemática processual recursal.

ABSTRACT: This article has the objective of analyzing the bill of New Code of Civil Procedure, especially about the appeal system from the perspective of effectiveness and celerity of the judicial process. The appeal system is one of the most criticized points in the actual code because of the lack of systematicity. In this sense, it sees to perform a critical review of Bill n. 8.046/10, in progress in House of Representatives, pointing its new provisions comparing to the current code.
