REFLEXOS DA CONVENÇÃO DE VIENA SOBRE DIREITO DOS TRATADOS NO ORDENAMENTO JURÍDICO BRASILEIRO – REPERCUSSION OF THE VIENNA CONVENTION ON LAW OF THE TREATRIES IN THE BRAZILIAN LEGAL SYSTEM

Após muitos anos de tramitação no Congresso Nacional, finalmente o Brasil ratificou em 2009 a Convenção de Viena sobre Direito dos Tratados. Tal ratificação impõe ao país importantes obrigações – entre elas a de cumprir com os acordos internacionais, conforme determina o texto da convenção. Sendo assim, a partir da internacionalização da Convenção de Viena, espera-se que o entendimento dos tribunais superiores acerca dos tratados internacionais seja reformulado, uma vez que, agora, o país compromete-se a não invocar direito interno como fundamento para descumprimento de obrigação assumida internacionalmente. Nesse sentido, o presente trabalho tem como objetivo a análise de alguns aspectos importantes da Convenção de Viena, assim como o impacto de sua ratificação no direito interno brasileiro.

ABSTRACT: After many years of debate in Congress, finally in 2009 Brazil ratified the Vienna Convention on the Law of Treaties. Such ratification imposes important obligations to the country - among them to comply with international agreements, as stipulated in the Convention text. Thus, from the internationalization of the Vienna Convention, it is expected that the understanding of the higher courts on international treaties is recast, as now, the country commits itself not to invoke internal law as grounds for breach of obligation assumed internationally. In that sense, this paper aims to analyze some important aspects of the Vienna Convention, as well as the impact of its ratification in Brazilian law.
