Este artigo procura trazer um panorama sobre a responsabilidade civil – especialmente a do Estado – por atos omissivos, perquirindo sobre os deveres positivos do Estado que ensejam a sua responsabilidade e sobre como a jurisprudência de nossos tribunais trata o tema.

ABSTRACT: This paper attempts to bring an overview of the liability, especially in the State for acts omissive, inquiring about the positive duties of the state that lead to its responsibility and as the jurisprudence of our courts is the issue.
