A ação condenatória representa um elemento que contribui para a ausência de efetividade do processo. A necessidade de utilização de um processo posterior, pelo titular da pretensão, milita contra a celeridade processual. Por outro lado, carrega exclusivamente para o autor o ônus processual: o titular de uma pretensão haverá de esperar a condenação para, somente então, ver iniciada a execução, capaz de atingir a realidade e de garantir o efetivo papel do direito processual.

ABSTRACT: The action chatter represents an element that contributes to the lack of effectiveness of the process. The need to use a process later, by the holder of the claim, militates against the speed of the procedure.
