ANÁLISE DA SEGURIDADE SOCIAL BRASILEIRA ANTE A TEORIA DA IGUALDADE DE RECURSOS – THE BRAZILIAN SECURITY ANALYSIS BEFORE THE THEORY OF EQUALITY OF RESOURCES

O artigo parte da seguridade social no Brasil com vistas a confrontá-la com o modelo proposto pelo filósofo do Direito Ronald Dworkin, em A Virtude Soberana: A Teoria e a Prática da Igualdade (2011). Nesta obra doutrinária, é pregado que os recursos dedicados à vida de cada pessoa devem ser iguais, integrando-se recursos privados e poder político. O mercado, a liberdade e a democracia são seus núcleos. Para uma boa compreensão, o leitor é ambientado à situação hipotética, proposta pelo autor, de divisão igualitária e legítima dos bens disponíveis em uma sociedade real, sem deixar de enfrentar as dificuldades e implicações inerentes, como a impossibilidade concreta, tanto de uma exata divisão material como da satisfação dos anseios peculiares a cada cidadão. A manutenção da igualdade atingida num sistema como tal, de livre comércio, e o respeito às individualidades e deficiências físicas e intelectuais também são inquietudes destacadas no trabalho. O objetivo é refletir sobre a possibilidade de se aprimorar a seguridade brasileira rumo ao equilíbrio entre a concepção que a originou, de bem-estar social, e os princípios liberais de mercado, que estão enraizados na sociedade. O arcabouço teórico ainda traz o debate de Amartya Sen e referências a Rawls, Bauman e Sartre. Conclui-se grande dificuldade de concretização das propostas difundidas por Dworkin, dado o gigantismo e a complexidade das sociedades reais, em especial a brasileira, mas sua teoria revela-se relevante para a reflexão da eficácia dos sistemas vigentes, quanto ao cumprimento dos anseios comuns, manifestados nos preceitos constitucionais.

ABSTRACT: This paper relates the Brazilian social equality, by facing it with the proposed model by the philosopher of law Ronald Dworkin, in Sovereign Virtue: The Theory and Practice of Equality (2011). This doctrinal work declares that the private resources dedicated to everybody's life must be the same, combining private and public resources. The market, the freedom and democracy are the center part. For a good comprehension, the reader is led to a hypothesized situation proposed by the author, by having a legal and equal share of disposable goods in a real society, without letting him face the inherent difficulties and implications, as the concrete impossibility, as an exact material division, or as the satisfaction of peculiar desires of each citizen. The maintenance of the reached equality on such a system, of free trade, and the respect of the individualities and physical and intellectual deficiencies are also concerns related in this paper. The aim is to reflect about the possibility to enhance the Brazilian security towards the balance between the conceptions of what has originated, of social welfare and liberal market principles that are rooted in the society. The theoretical framework still brings the debate by Amartya Sen, and refers to Rawls, Bauman and Sartre. It is very difficult to realize the proposed broadcast by Dworkin, given the gigantism and the complexity of real societies, especially the Brazilian one, but his theory reveals itself relevant to the reflection of the effectiveness of the current systems, by fulfilling the common aspirations, manifested in constitutional precepts.
