COLABORAÇÃO NO PROCESSO CIVIL E O PROJETO DO NOVO CÓDIGO DE PROCESSO CIVIL – COLLABORATION IN CIVIL PROCEDURE AND THE PROJECT OF THE NEW CIVIL PROCEDURAL CODE

O presente ensaio visa a apresentar, em um primeiro momento, o modelo colaborativo de organização do processo civil no Estado democrático de direito, confrontando-o com as configurações liberal e social do Estado e suas respectivas formas de distribuição do papel das partes e do juiz. Nessa perspectiva, será feita uma análise de como o tema é tratado no Projeto do Novo Código de Processo Civil, traçando-se um paralelo com o sistema vigente e oferecendo-se algumas críticas à proposta legislativa.

ABSTRACT: This essay aims to present, at first, the collaborative model of organization of civil procedure in a democratic state, confronting it with the liberal and social settings of the state and their respective ways of distributing the role of the parties and the judge. From this perspective, there will be an analysis of how the issue is addressed in the Project of the New Code of Civil Procedure, by drawing a parallel with the existing system and offering critiques of the proposed legislation.
