DIREITO DE AUTOR EM PERSPECTIVA HISTÓRICA: DA IDADE MÉDIA AO RECONHECIMENTO DOS DIREITOS DA PERSONALIDADE DO AUTOR - COPYRIGHT IN HISTORICAL PERSPECTIVE: FROM THE MIDDLE AGES TO THE EMERGENCE OF THE MORAL RIGHTS OF THE AUTHOR

O artigo aborda os aspectos históricos mais relevantes do Direito de Autor. Inicia as investigações na Idade Média e Moderna, cuidando da invenção da imprensa de tipos móveis, do regime dos privilégios, bem como do sistema de censura criado pelos Estados para o controle da publicação das obras. Trata do fim dos privilégios na Inglaterra e do surgimento do sistema do copyright em 1710, com a entrada em vigor do Estatuto da Rainha Ana. Examina a propriedade literária, artística e científica, cujo fundamento remonta aos decretos revolucionários franceses de 1791 e 1793 e marca a aparição do moderno sistema de Direito de Autor. Por fim, o estudo investiga a construção dos direitos morais do autor pela jurisprudência francesa.

ABSTRACT: The article discusses the most relevant historical aspects of the copyright. The investigations begin in the Middle and Modern Ages, taking care of the invention of printing, the regime of privileges, as well as the censorship system created by the states to control the literacy works. The paper makes a study about the end of privileges in England and the emergence of the copyright system in 1710, with the entry into force of the Statute of Queen Anne. It examines the literary, artistic and scientific property, which emerged in France with the revolutionary laws of the years 1791 and 1793. Finally, it investigates the construction of the moral rights of the author by the French courts.
