ESTUDO SOBRE AS AÇÕES AFIRMATIVAS – STUDY ON AFFIRMATIVE ACTIONS

O presente artigo tem como objeto a análise histórica, o estudo teórico e a identificação das consequências práticas das ações afirmativas. Na sua elaboração, obras doutrinárias, legislação brasileira e estrangeira, e casos jurisprudenciais foram as principais fontes de pesquisa utilizadas. A partir daí, foi possível a determinação pontual, mas não restritiva, das origens históricas; o desenvolvimento teórico do instituto; e o exame da sua aplicabilidade à luz dos preceitos constitucionais, dos ideais democráticos e dos direitos humanos internacionalmente consagrados, respeitado o pragmatismo do qual não se pode esquivar.

ABSTRACT: The aim of this article is the historical analysis, the theoretical study and the identification of the practical consequences of affirmative actions. During the elaboration, theoretical works, Brazilian and foreign legislation, and jurisprudence were the main sources used. Then, it was possible to establish accurately, but not exhaustively, its historical origins; the theoretical evolution; and the examination of its applicability under the constitutional principles, the democratic ideals and the human rights internationally recognized; considering the pragmatism which cannot be disregarded.
