INCIDENTE DE RESOLUÇÃO DE DEMANDAS REPETITIVAS: TUTELA COLETIVA OU PADRONIZAÇÃO DO PROCESSO? – COLLECTIVE PROTECTION OR STANDARDIZATION PROCESS?

Com o projeto do novo Código de Processo Civil tramitando na Câmara dos Deputados, ainda há uma sucessão de leis para alterar a legislação processual civil vigente. O projeto busca adequar o processo a uma nova era, mas será preciso uma nova legislação? Dentro dessa nova legislação, há novos instrumentos, sendo o interesse no presente artigo por um instrumento específico: o incidente de resolução de demandas repetitivas. Será que ele representará o esvaziamento da tutela coletiva ou será apenas mais uma forma de padronização do processo? É essa indagação que se presente responder ao longo do presente trabalho.

ABSTRACT: While we are designing a project of the new Code of Civil Procedure under consideration in the House of Representatives, there is a succession of laws to change the current civil procedural law. The project seeks to adapt the process to a new era, but do we need is a new legislation for this? And within this new legislation, new instruments will come. The interest of this article is in a specific instrument: the incident resolution demands repetitive. Does he represent the empty of collective protection or is it just another form of test claims? This is the question that this paper will analyze.
