¿JUSTICIA DE LOS VENCEDORES O CASTIGO AL IMPERIALISMO? POSICIONES DE LA IZQUIERDA FRENTE AL DERECHO INTERNACIONAL PENAL – VICTOR’S JUSTICE OR PUNISHMENT TO IMPERIALISM? POSITIONS ADOPTED BY THE LEFT REGARDING INTERNATIONAL CRIMINAL LAW

En este trabajo pretendemos compilar y analizar algunos de los aportes y críticas realizados desde la izquierda al surgimiento del derecho internacional penal (DIP). Clasificaremos las distintas posiciones posibles en: a) críticas radicales, que apuntan a las propias raíces de la disciplina, denunciándola por expandir aún más el tan cuestionado poder punitivo de los Estados y objetando la legitimidad de los tribunales; b) críticas inmanentes, que no apuntan al ideal normativo del DIP en sí, sino a las fallas materiales en la implementación de dicho ideal; y por último c) elogios al desarrollo histórico del DIP. Tras un recorrido por una serie de fuentes históricas y bibliográficas, concluiremos que la izquierda ha ejercido principalmente un rol de crítica inmanente del DIP, optando por no cuestionar los fundamentos que sostienen la disciplina. Finalmente, realizaremos algunas reflexiones sobre estas conclusiones empíricas obtenidas.

ABSTRACT: In this paper we pretend to compile and to analyze some of the contributions and criticisms performed by the left to the dawning of international criminal law. We classify the different possible positions in: a) radical criticism, which aims at the very foundations of international criminal law, denouncing it for further expanding the already questionable criminal power of the States, and objecting the legitimacy of international tribunals; b) immanent criticism, which does not aim at the normative ideal of international criminal law, but to the material failures in its implementation; and lastly c) praise to the historical development of international criminal law. After exploring a series of historical and bibliographical sources, we will conclude that the left has tended to a position of immanent criticism, deciding not to question the foundations of international criminal law. Finally, we will make some comments on these empirical conclusions.
