O PAPEL DO ORÇAMENTO NA EFETIVAÇÃO DE DIREITOS SOCIAIS - BUDGET ROLE IN SOCIAL RIGHTS FULFILLMENT

O presente trabalho busca refletir sobre o papel do orçamento na efetivação dos direitos sociais. Demonstra que as leis orçamentárias devem ser subordinadas aos direitos fundamentais, e não ao contrário: longe de ser uma carta em branco para o Poder Executivo, o orçamento deve ser visto como instrumento de planejamento e desenvolvimento econômico e social.

ABSTRACT: This paper reflects on the budget role in the social rights fulfillment. Budget laws should be subject to fundamental rights and not otherwise. Far from being a carte blanche for Executive Branch, budget should be seen as a tool for planning and also economic and social development.
