OS REFLEXOS DO CIBERDIREITO AO DIREITO DA PERSONALIDADE: INFORMAÇÃO VS. DIREITO À INTIMIDADE – CYBERLAW CONSEQUENCES ON PERSONALITY RIGHTS: INFORMATION VS. RIGHT TO PRIVACY

O texto apresenta um esboço sobre os direitos da personalidade e uma proposta de proteção da imagem e da intimidade das pessoas na internet, trazendo algumas decisões que reconheceram a violação à imagem nos redes sociais e reconheceram o direito a indenização e a responsabilidade do site hospedeiro. A internet, sendo um veículo de comunicação com enorme velocidade de informações, transforma pessoas em heróis de popularidade, seja por ridicularizar seja por expor a privacidade das pessoas, condutas que devem ser reprimidas através de controle pelo Judiciário. A sociedade vivencia o culto à imagem aos vídeos e todo tipo de apelo transforma as pessoas em segundos e divulga ao mundo a ideia da coisificação do ser humano.

ABSTRACT: The paper presents an outline on the rights of personality and a proposed image protection and personal privacy on the internet, bringing some decisions that recognized the violation to the image in social networks and recognized the right to indemnification and liability host site. The internet, as a vehicle for communication of information with great speed, turns people into heroes of popularity, either by ridicule or expose the privacy of individuals, behaviors that must be suppressed by the Judiciary control. The society experiences the cult of image videos and all kinds of appeal turns people into seconds and announces to the world the idea of commodification of human beings.
