A PROPRIEDADE INDUSTRIAL BIOTECNOLÓGICA AGRÍCOLA E SUA FUNÇÃO SOCIAL – THE PROPRIETARY AGRICULTURAL BIOTECHNOLOGY AND ITS SOCIAL ROLE

A propriedade industrial biotecnológica agrícola desempenha papel estratégico nas sociedades modernas, contribuindo para a melhoria na competitividade das empresas. Há, contudo, na tutela desse bem imaterial a necessidade de direcioná-lo em consonância ao respeito aos princípios constitucionais, aqui em especial a função social da propriedade. Esse trabalho analisará esse importante direito fundamental da propriedade industrial, sua evolução, seu papel estratégico e controvérsias jurídicas envolvidas com a transgenia e a real função social das biotecnologias agrícolas em face de sua adequação à função social da propriedade, bem como sua melhor conformação diante dos riscos ao meio ambiente sadio e à segurança alimentar e nutricional. Assim, a propriedade industrial biotecnológica agrícola deverá passar, obrigatoriamente, pelo filtro do princípio da função social da propriedade, visualizando como fundamental para a busca da autonomia biotecnológica nacional. No entanto, seus riscos devem ser avaliados com rigor diante das consideráveis incertezas científicas sobre os possíveis danos ambientais e à saúde pública.

ABSTRACT: The proprietary agricultural biotechnology plays a strategic role in modern societies, helping to improve the competitiveness of enterprises. There is, however, immaterial in the protection of the need to direct in line to respect constitutional principles, here, in particular, the social function of property. This paper will examine this important fundamental right of industrial property, its evolution, its strategic role and legal controversies involved with transgenic and real social function of agricultural biotechnologies in the face of their suitability for the social function of property, as well as its best conformation before risks to the environment and healthy food and nutritional security. Thus, proprietary agricultural biotechnology must pass obligatorily by the filter of the principle of the social function of property, viewing as fundamental to the pursuit of national autonomy biotechnology. However, its risks should be evaluated rigorously in the face of considerable scientific uncertainty about the possible environmental damage and public health.
