A SOCIALIZAÇÃO DA RESPONSABILIDADE CIVIL: A EVOLUÇÃO DO SUBJETIVO-LIBERAL AO OBJETIVO-SOCIAL: THE SOCIALIZATION OF CIVIL RESPONSABILITY: FROM SUBJECTIVE-LIBERALISM TO THE SOCIAL IDEAL

A responsabilidade civil tem experimentados alterações quanto a função social e até mesmo quanto aos efeitos nela contidos. As alterações sociais ao longo da história, deixando um viés patrimonialista, passando por uma noção de Estado Social, impregnaram neste instituto uma abordagem solidarizante, em que a vítima deixou de ter a obrigação de demonstrar a culpa do causador dano para a necessidade de demonstrar a existência do dano e a ocorrência do nexo causal. A verdadeira evolução do instituto representa a valorização do ser, colocando a dignidade humana em primeiro plano.

ABSTRACT: The liability has experienced changes as the social and even the effects it contains. Social changes throughout history, leaving a way through a patrimonial notion of social state, ingrained in our institute solidarizing approach where the victim no longer has the obligation to prove the guilt of causing damage to the need to demonstrate the existence of damage and the occurrence of a causal connection. The real evolution of the institute represents the valuation of the putting human dignity in the foreground.
