CASO RIOCENTRO: UM PANORAMA HISTÓRICO-JURÍDICO – “CASO RIOCENTRO”: A HISTORICAL-JURIDICAL PERSPECTIVE

O artigo objetiva apresentar um panorama sobre o conhecido Caso Riocentro, ocorrido em 30/4/1981, no bairro de Jacarepaguá, na cidade do Rio de Janeiro, quando duas bombas explodiram no local, notadamente a partir do que restou discutido e decidido no Habeas Corpus nº 2014.02.01.0056847, julgado no dia 2/7/2014 pela 1ª Turma Especializada do Tribunal Regional Federal da 2ª Região. Tendo em vista que, ao final, será o Poder Judiciário que decidirá se os fatos cometidos na ocasião poderão redundar em responsabilização penal (ou de outra natureza) dos militares denunciados pelo Ministério Público Federal, cumpre trazer à tona alguns aspectos históricos que circundam o tema, bem como uma síntese dos debates a respeito das principais teses jurídicas abordadas pelos diversos atores envolvidos na discussão que se travou quando do julgamento do mencionado remédio heroico, esperando contribuir, assim, para a difusão das decisões judiciais exaradas pelo Poder Judiciário Federal da 2ª Região.

ABSTRACT: The present article aims to present a perspective about the renowned “Caso Riocentro”, which happened on April 30th 1981, in the neighborhood of Jacarepagua, Rio de Janeiro, where two bombs exploded, especially regarding what was discussed and decided in the Habeas Corpus 2014.02.01.0056847, judged on July 2nd 2014 by the First Specialized Group of the Federal Regional Court of the 2nd Region. Considering that, in the end, it will be the Judiciary Power the one which will decide if the facts committed on the occasion will end with the criminal accountability (or of other nature) of the military indicted by the Federal Prosecution, we must bring to light some historical aspects that surround this subject, as well as a synthesis of the debates regarding the main juridical thesis mentioned by the various subjects involved in the discussion occurred when the aforementioned habeas corpus was trialed, hoping to contribute, therefore, for the diffusion of the judicial decisions emanate from the Judiciary Power of the 2nd Region.
