CLASSIFICAÇÃO INDICATIVA E VINCULAÇÃO DE HORÁRIOS NA PROGRAMAÇÃO DE TV: A FORÇA DAS IMAGENS E O PODER DAS PALAVRAS – CONTENT RATING AND WATERSHED PROGRAMMING ON TELEVISION: THE POWER OF IMAGES AND WORDS

O presente artigo analisa a viabilidade constitucional da imposição de barreiras de horários para exibição de programação inadequada para crianças na TV aberta, a partir dos argumentos até agora ventilados no julgamento, em curso no Supremo Tribunal Federal, da Ação Direta de Inconstitucionalidade (ADI) nº 2.404. O objetivo é demonstrar a complexidade do conflito entre liberdade e intervenção nesse domínio específico, que aponta para uma solução, que, embora rejeitando o controle prévio da programação, reconhece a constitucionalidade do estabelecimento de marco regulatório que discipline limites temporais relacionados à classificação por faixa etária na programação na TV aberta.

ABSTRACT: This article assesses the constitutionality of State imposition of programming watersheds on broadcast television, taking as its starting point the arguments used by the Brazilian Supreme Court during the ongoing judgment of the Unconstitutionality Action n. 2,404. The aim of the article is to show the complexity of the conflict between freedom of speech and fundamental rights of children in this specific type of media, pointing to a solution that rejects the possibility of previous state control and content ban, but recognizes the constitutionality of regulatory time restrictions connected to age classification of broadcast TV programming.
