CONSTITUCIONALISMO INCLUSIVO E A PROTEÇÃO ESTATAL AO TRABALHO DA PESSOA COM DEFICIÊNCIA – INCLUSIVE CONSTITUCIONALISM AND THE STATE PROTECTION OF DISABLED WORKERS

O presente artigo propõe-se ao estudo do grau de efetividade constitucional havido na inclusão social da pessoa com deficiência através de sua inserção no ambiente laborativo. Resulta da investigação científica no domínio jurídico-positivo e do levantamento em campo de dados coletados via metodologia empírica. Para tanto, examina-se a proteção legal as pessoas com deficiência no Direito Constitucional brasileiro, bem como o confronto dessa base legal com os dados estatísticos. Dessa maneira, alcança-se uma descrição apurada do quadro normativo e da realidade empírica que circunda o tema. Em torno da análise, ao final, realiza-se análise crítica sobre as razões da (in)efetividade do direito posto.

ABSTRACT: This paper’s objective is to study the degree of constitutional effectiveness concerning the social inclusion of people with disabilities through their integration within the labor market. It is the result of a scientific research in the domain of positive law as well as survey in field of data collected using empirical methodology. For this purpose, it will be examined the legal protection of disabled people in the Brazilian Constitutional Law, and this legislation is also contrasted with the statistics obtained. By this way, it is reached an accurate description of the normative framework and the empirical reality surrounding the theme. Revolving around the analysis, in the end, it is performed a critical analysis of the effectiveness of current legislative model.
