A DECISÃO JUDICIAL E SUA RELAÇÃO INTERSISTÊMICA JURÍDICA E ECONÔMICA – THE JUDICIAL RESOLUTION AND ITS INTERSYSTEM LEGAL AND ECONOMIC RELATIONSHIP

A partir da Teoria dos Sistemas Sociais, proposta por Niklas Luhmann, este trabalho discorre sobre as implicações das decisões judiciais no âmbito da aproximação dos sistemas jurídico e econômico. Aborda a matriz epistemológica e os pressupostos da teoria dos sistemas, evidenciando a relativização do Direito como sistema autopoiético diante de sua inter-relação com o sistema econômico. Desse modo, parte-se de estudos que envolvem as observações dos vínculos entre o Direito e a Economia, em relação à compreensão de que esses sistemas sociais são diferenciados, operacionalmente fechados, autopoiéticos e precisam comunicar-se para buscar uma adaptação ao novo ambiente, por meio do acoplamento estrutural.

ABSTRACT: From the theory of social systems proposed by Niklas Luhmann, this paper discusses the implications of judgments within the approximation of the Legal and Economic Systems. It addresses the epistemology and assumptions of systems theory, showing the relativity of Law as an autopoietic system before its interrelation with economic system. It goes from observations of the links between Law and Economics towards the understanding that these social systems are distinguished, operationally closed, autopoietic and need to communicate to seek an adjustment to the new environment by means of structural engagement.
