A FUNÇÃO ATIVA DO CÁRCERE NO SISTEMA PENAL BRASILEIRO – ACTIVE ROLE OF PRISON IN BRAZILIAN CRIMINAL SYSTEM

O presente artigo tem como objetivo analisar o sistema penal de maneira crítica, a fim de meditar sobre a distância entre o discurso oficial e a real função exercida pelo sistema penal em nossa sociedade capitalista, apontando-o como fonte geradora da reprodução da realidade social existente, ou seja, como um dos mantenedores do status quo. Pretendemos demonstrar que o cárcere é apenas um pequeno pedaço que constitui o sistema penal burguês, sendo parte de um conjunto de filtros sucessivos aos quais são submetidas as classes subalternas da sociedade. A prisão é reprodutora de desigualdades sociais, tratando-se de um instrumento de exclusão social, ao contrário dos seus fins oficialmente declarados, e está a serviço de uma classe dominante. Para tanto, almeja-se ensejar reflexões sobre a exclusão social e sua relação com o sistema penal.

ABSTRACT: This papers aims to analyze the penal institution in a critical way to meditate on the distance between the official discourse and its actual function performed by the criminal justice system in our capitalist society, pointing it as a source for the reproduction of social reality, that is, as one of the status quo maintainers. It is intended to show that the prison is just a small piece in criminal justice system, as part of a group of successive filters towards lower classes of society. The prison is a player of social inequalities as an instrument of marginalization, unlike the officially declared purposes, and is a service for the ruling class. At last, thoughts on social marginalization and its relationship to the criminal justice system are given life.
