INOVAÇÕES LEGISLATIVAS PARA O APRIMORAMENTO DA DEFENSORIA PÚBLICA NO BRASIL: INDEPENDÊNCIA, ACCOUNTABILITY E A REDUÇÃO DAS DESIGUALDADES SOCIAIS – LEGAL REFORMS FOR LEGAL AID DELIVERY IN BRAZIL

A Defensoria Pública é a instituição estatal brasileira que tem por encargo a obrigação de prestar assistência jurídica integral (judicial e extrajudicial) e gratuita àqueles que não podem pagar as despesas de contratação de advogado, qualquer que seja o tipo de causa ou questão de cunho jurídico a ser resolvida. A Constituição Federal de 1988 estabelece que a Defensoria Pública é instituição essencial à função jurisdicional do Estado, de tal modo que a deficiência no funcionamento de tal órgão interfere e impede o adequado funcionamento do próprio Poder Judiciário. Recentes inovações legislativas fortaleceram ainda mais a importância da Defensoria Pública, conferindo-lhe autonomia administrativa e financeira. A nova legislação também ampliou os objetivos e funções institucionais da Defensoria Pública, estabelecendo ainda novos mecanismos de controle e prestação de contas (accountability) quanto ao desempenho de suas atividades. O objetivo deste artigo é proporcionar uma visão geral do alcance dessas reformas legislativas, com vistas a consubstanciar como elas contribuem para o objetivo de transformar a Defensoria Pública na instituição estatal com potencial e obrigação de trabalhar para a redução das desigualdades sociais através do Direito.

ABSTRACT: The Office of Public Defenders (OPD) is the Brazilian state institution mandated with the obligation to provide legal (judicial and extra-judicial) assistance to those who cannot afford a lawyer, in all areas of law. The 1988 Constitution deems the OPD essential to the state judicial function itself, in such an ontological manner that the latter cannot be properly understood without reference to the OPD. Recent legal reforms have further increased the importance of the OPD, by conferring on it administrative and financial autonomy. The new legislation has also expanded the objectives and mandates of the OPD, and established new accountability mechanisms.
