Para uma decisão legítima, revela-se fundamental a análise do procedimento democrático que a gestou, bem como seu exame de mérito, considerando-se, especialmente, a responsabilidade política do julgador. A garantia dos meios procedimentais e materiais de fortalecimento da democracia, nesse sentido, contribui de forma decisiva para a adequação da decisão. A arbitrariedade, avessa à democracia, conduz à instabilidade jurídica e à insegurança do sistema jurídico.

ABSTRACT: For a legitimate decision, becomes vital the analysis of the democratic process that nurtured it, as like its merit exam, considering especially the politic responsibility of the judge. The guarantee of procedural and material of strengthening democracy in this sense, contribute decisively to an appropriateness of the decision. The arbitrariness, averse to democracy, leads to the legal instability and uncertainty of the legal system.
